Italy Digital Nomad Visa Specialist Law Firm

Recently, Italy introduced new rules to permit non-EU citizens who are considered “digital nomads” to enter Italy and spend a year living and working remotely.

The new “digital nomad visa” is aimed at non-EU citizens who “carry out highly qualified work activities through the use of technological tools that allow them to work remotely, autonomously, or for a company that is not resident in the territory of the Italian state.”

These new rules will allow non-EU citizens to live in Italy by working remotely without applying for one of the Italian residence permits for work reasons within the usual annual quotas established by the “Decreto Flussi” pursuant to Legislative Decree No. 286 of 1998 (Testo Unico Immigrazione).

Do I qualify?

This rather broad definition of “highly qualified worker” seems to cover both self-employed and employed workers. Furthermore, being aimed at “digital nomad” workers, it does not include manual workers or persons who have to be predominantly present in the workplace to perform their jobs.

How does it work?

Step 1:

An application is submitted for the Digital Nomad Visa at the nearest Italian consulate in your country of citizenship or permanent residence.

The documentation you have to present is not always easy to collect and prepare, and on many occasions, is bound to involve long waiting periods with public administration. How long is it valid for?

The Digital Nomad Visa is valid for six months and can then be renewed for further six months, without the applicant becoming a tax resident - another benefit to this welcome visa.

If the applicant decides that they want to apply for the residence permit, during that period, either before or after the extension, they should apply for the residence permit as an independent worker, which can be done from within Portugal whilst on the Digital Nomad Visa.

Once you visa has been approved and Within eight days of arrival in Italy, applicants must apply for a residence permit at the police headquarters within the province where they reside. The permit will be issued related to the specific category of digital nomad /remote worker.

The Digital Nomad visa is valid for 1 year and can then be renewed providing the criteria is still being met by the holder.
